1.Terms Acceptance

These Website Terms of Service (the “Terms”) govern your use of websites operated by or on behalf of Deals on Wheels  (“Deals on Wheels,” “we,” or “us”). Please read these Terms carefully because they affect your legal rights. Please keep in mind that Section 15 of these Terms contains a mandatory arbitration provision that requires you to use arbitration on an individual basis and limits your remedies in the event of certain disputes.

You agree to be bound by these Terms and all of the terms incorporated herein by reference by accessing or using https://dealsonwheels.ae/ (sometimes referred to as the “Site”) and our various related websites and services, including, without limitation, the underlying software and data (collectively, the “Deals on Wheels”).

To use Deals on Wheels, you must be at least 18 years old. By accepting these Terms, you represent that you have the legal authority to do so and that if you have accepted these Terms on behalf of any person or entity, that person or entity agrees to be responsible to us if you or such person or entity violates these Terms. If you do not agree to every provision of these Terms, you may not access or use Deals on Wheels or any features provided therein, and we do not authorize you to do so.

You represent and warrant that you have not previously been suspended or removed from Deals on Wheels or engaged in any activity that could result in suspension or removal from Deals on Wheels by accessing or using Deals on Wheels.

We reserve the right to change these Terms at any time for any reason and to notify you of any changes by any reasonable means, including through Deals on Wheels. The “Last Updated” legend at the top of these Terms will tell you when we last updated these Terms. Except where express consent to any revised Terms is required by applicable law, you agree to any revised Terms by continuing to access, browse, or use Deals on Wheels. If you do not agree to any revised Terms, you may not use Deals on Wheels, and we will not authorize you to do so. We strongly advise you to return to this page on a regular basis to review these Terms.

You must first register with Deals on Wheels in order to list, sell, or buy on the Site. You must create an account and provide your real name, address, phone number, and email address to register.

You authorize Deals on Wheels to charge your credit card for amounts owed by listing an item on the Site. Unless otherwise specified, all fees are in US dollars.

2. Role of Deals on Wheels

2.1 Buyers and third-party sellers can use this location.

You agree that, except as stated in Sections 2.2 and 3, Deals on Wheels is a place where third-party sellers (“3rd Party Sellers”) and third-party buyers (“Buyers”) of vehicles can do business (“3rd Party Transactions”) through Deals on Wheels. Deals on Wheels is not involved in 3rd Party Transactions and shall bear no liability for them, except in its capacity as a seller or buyer as described in Sections 2.2 and 3 (“Deals on Wheels Transactions”). Deals on Wheels is not an agent of, and has no authority over, any third-party sellers or buyers involved in third-party transactions. Deals on Wheels has no control over, and thus disclaims any responsibility and liability for, the quality, safety, legality, or description of the items advertised or sold by 3rd Party Sellers through Deals on Wheels.

Deals on Wheels doesn’t take any responsibility or liability for any listing from a 3rd Party Seller, no matter how accurate, complete, misleading, or dishonest it is. It also disclaims all representations and liabilities that come from the above. Deals on Wheels also has no control over whether or not 3rd Party Sellers are able to sell the items they list or whether or not Buyers are able to buy the items from 3rd Party Sellers. Deals on Wheels also does not guarantee that any Buyer or 3rd Party Seller will receive payment for or shipment of any item that is part of a 3rd Party Transaction. Buyers and third-party sellers who take part in third-party transactions agree that Deals on Wheels is not responsible for making sure that any of the parties involved in the transaction meet their obligations. When making a deal with a third-party seller, you should always be careful. To protect yourself, you may want to use a third-party escrow agent. Participants in 3rd Party Transactions must follow these Terms as well as all applicable U.S. and foreign laws, rules, and regulations.

2.2 Deals on Wheels in the role of Buyer or Seller

Deals on Wheels can take part in a transaction as either a buyer or a seller. Under certain terms and conditions, Deals on Wheels enters into a Deals on Wheels transaction.

3. Vehicle Purchases, Sales, and Consignment

3.1Vehicle Sales via Deals on Wheels

If you want to sell a vehicle to Deals on Wheels via Deals on Wheels services, you must agree to the purchase terms and conditions available 

3.2 Vehicle Purchase via Deals on Wheels

If you want to buy a vehicle from Deals on Wheels through Deals on Wheels Services, you must agree to the vehicle sale agreement.

3.3 Using Deals on Wheels Services to Consign a Vehicle

If you want to use Deals on Wheels Services to sell a car, you know that you will have to sign the Deals on Wheels Consignment Agreement.

3.4 Sales and Use Taxes

You understand and agree that it is the responsibility of the buyers and 3rd party sellers to figure out if any taxes (such as sales, use, or luxury taxes) apply to any 3rd party transactions and to collect, report, and send the correct tax to the right tax authority. You also understand and agree that Deals on Wheels is not required to figure out if taxes (such as sales, use, or luxury taxes) apply to any third-party transaction and is not responsible for collecting, remitting, or reporting any taxes that come from any such transaction.

4. Users Registration

To access and use certain parts or features of Deals on Wheels Services, you may need to give certain information or answer certain questions. Each registration is for one user only. You agree to (a) give us information that is accurate, up-to-date, and complete; (b) keep your information up-to-date as needed; (c) be responsible for the actions or inactions of any third party who has permission to access or use Deals on Wheels Services on your behalf, and (d) tell us right away if you find or suspect any security breaches related to Deals on Wheels Services. If you give us false, wrong, out-of-date, or incomplete information, we may suspend or end your use of Deals on Wheels Services now or in the future.

You agree to get electronic communications from Deals on Wheels by giving information and/or answering questions (for example, by email or by posting notices to Deals on Wheels Services). You should keep copies of electronic communications from us, either on paper or electronically. We may also send you promotional communications via email, such as newsletters, special offers, surveys, and other news and information that we believe will be of interest to you. You can stop getting these marketing emails at any time by following the instructions on how to unsubscribe.

5. Access to and Use of Deals on Wheels Services and Content

Unless we say otherwise in writing, Deals on Wheels Services and all content and other materials on them, including, but not limited to, service marks or logos, and all designs, text, graphics, pictures, information, data, software, and other files, as well as their selection and arrangement, are the property of De. All rights not expressly granted in this document are reserved. Under these Terms, you do not acquire any ownership interest in Deals on Wheels Services and all content and other materials contained therein, including, without limitation, Content, or any other rights to them, other than the right to use Deals on Wheels Services and all content and other materials contained therein, including, without limitation, in accordance with the right granted and subject to all of the terms, conditions, and restrictions of these Terms.

You have no right to, and shall not, directly or indirectly: (a) sell, resell, or use commercially Deals on Wheels Services or Content; (b) distribute, publicly perform, or publicly display Deals on Wheels Services or any Content; (c) modify or otherwise make any derivative uses of Deals on Wheels Services or Content, or any portion thereof; (d) use any data mining, robots, or similar data gathering or extraction methods;

Any use of Deals on Wheels or content other than as expressly authorized herein is strictly prohibited and will entitle us to terminate your right of access and use granted herein. Copyright and trademark laws, as well as communications laws and regulations, may also be broken if someone uses someone else’s work without permission. Except as expressly permitted herein, nothing in these Terms shall be construed as conferring any right or license to any Deals on Wheels or third-party patent, trademark, copyright, or other proprietary rights, whether by estoppel, implication, or otherwise.

You won’t remove, change, or hide any copyright, trademark, service mark, or other proprietary rights notices that are part of or accompany any Content. You also won’t perform, display, publish, distribute, transmit, broadcast, sell, license, or otherwise use any Content.

We reserve the right, at our sole discretion, to change, suspend, or discontinue Deals on Wheels services (or any features or parts thereof) at any time.

We retain all rights permitted by law or otherwise, including, without limitation, the right to immediately halt any listing or deny, restrict, or terminate your access to the Site or Deals on Wheels (with or without cause or reason), including, without limitation, if you engage in any of the illegal or prohibited activities enumerated in these Terms. We also reserve the right to delete any listing or other information at our sole and absolute discretion, with or without a reason. This includes, but is not limited to, any listing or other information that violates these Terms or is otherwise offensive or unacceptable to us.

6. Trademarks

The Deals on Wheels logo and any other product or service names, trademarks, logos, or other signs (“Marks”) that appear on Deals on Wheels Services are the property of Deals on Wheels or its subsidiaries, affiliates, or third parties. They cannot be copied, imitated, or used, in whole or in part, without our written permission. Nothing in these Terms or the Deals on Wheels Services should be interpreted as granting, implicitly or explicitly, any license or right to use any such marks without the prior written permission of Deals on Wheels or any third party who may own such marks. It is against the law to use these marks without permission in a way that could confuse or dilute the brand.

7. Legal Prerequisites; Privacy Policy

Our Privacy Policy describes how we handle the personal information you provide us when using Deals on Wheels Services. Please see our Privacy Policy for more information on our privacy practices.

8. User-Generated Content

You are solely responsible and liable for all data, information, and other materials (“User Content”) that you submit, upload, post, email, or otherwise send in connection with Deals on Wheels Services (“Transmit”). Also, we have no control over how information made public through Deals on Wheels Services is used or abused by third parties, and we are not responsible for any damages that happen as a result. This includes, but is not limited to, republishing. If you choose to send us or make public any user content, you do so at your own risk, and we won’t be responsible in any way.

You can only use the site and Deals on Wheels services in ways that are legal and for legal reasons. You agree to follow all laws, rules, and regulations when you use the Deals on Wheels services, such as when you list, buy, or ask for offers to buy. You agree not to engage in any of the prohibited activities listed below:

1. You shall not register under a false name or use an invalid or unauthorized credit card

2. You shall not impersonate any person or entity;

3. You must not use the password(s) of another person or entity.

4. You shall not list, post, or transmit any item, link, or material that infringes any third rights, parties such as contractual rights or intellectual property rights, such as copyrights, trademarks, patents, trade secrets, or other proprietary rights (including rights of publicity or privacy);

5. You can’t list, post, or send anything that is fake, illegal, stolen, or a scam.

6. You shall not list, post, or transmit any information that in any way violates any person’s or entity’s privacy-related rights under US or foreign laws, rules, or regulations.

7. You can’t list, post, or send any information that could be seen as false or hurtful about a person, business, or their products or services.

8. Unless expressly authorized by Deals on Wheels, you shall not list or post any links to commercial or private websites for the purpose of advertising non-Deals on Wheels services.

9. You shall not list, post, or transmit any information that could reasonably be construed as evidence of, or an element of, collusion, monopolization, predatory conduct or pricing, a refusal to deal, below-cost sales, price squeezing, or any other violation of any U.S. or foreign laws, rules, or regulations prohibiting antitrust or anti-competitive activities or unfair trade practices.

11. You shall not list, post, or transmit any unsolicited advertising or promotional materials or other forms of solicitation

12. You can’t use the site or Deals on Wheels services to harass, threaten, abuse, embarrass, or cause distress, unwanted attention, or discomfort to any other person or entity in any way, including by using vulgar, hateful, abusive, threatening, or otherwise offensive language or information.

You agree not to and will not allow anyone else, directly or indirectly: (a) Transmit any User Content that is illegal, harmful, threatening, abusive, hateful, obscene, harassing, tortious, defamatory, libellous, slanderous, pornographic, profane, vulgar, offensive, lewd, invasive of another’s privacy, racially, ethnically, or otherwise objectionable; (b) Transmit any User

Even though we are not required to screen, edit, or monitor user content, we reserve the right and have complete freedom to remove, screen, or edit user content posted or stored on Deals on Wheels Services at any time and for any reason. You are the only one who is responsible for making backup copies of any User Content you post or store on Deals on Wheels Services and replacing it if it gets lost or damaged.

9. User Content Rights

We make no claim to ownership of user content. However, by uploading, posting, or submitting User Content to the Deals on Wheels Services or our pages or feeds on third-party social media platforms (for example, Deals on Wheels’ Facebook page, Instagram page, LinkedIn page, or Twitter feed), you hereby grant Deals on Wheels a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, and fully sublicensable right and license to use, reproduce, modify, adapt.

You agree that Deals on Wheels may share or use any User Content for any legal purpose, such as (a) enforcing these Terms; (b) complying with any laws, regulations, or rules of any federal, state, local, or foreign government or agency; (c) responding to claims that any User Content violates the rights of third parties; or (d) protecting the rights or property of Deals on Wheels, its customers, or the public.

10. Feedback

You can submit questions, comments, suggestions, ideas, original or creative materials, or other information about Deals on Wheels or Deals on Wheels Services in addition to user content (collectively, “Feedback”). Feedback will be the sole property of Deals on Wheels. Deals on Wheels will own all rights to Feedback, including intellectual property rights, and will be able to use and share Feedback for any reason, commercial or not, without giving you credit or paying you anything.

11. Third-Party Sites

We haven’t looked at all of the websites that link to Deals on Wheels Services, so we’re not responsible for the content of any third-party pages, any other websites that link to Deals on Wheels Services, or any products or services offered by third parties. Nothing in Deals on Wheels Services, including links to other websites, should be taken as an endorsement by Deals on Wheels of the products, services, or information of other people or companies. If you click on a link to another website, you do so at your own risk, and you agree to follow all of the rules for that website. Deals on Wheels can choose not to link to a certain website or take the link down at any time.

Links to websites not run by Deals on Wheels are provided as a service. We don’t have any control over these linked sites and don’t make any promises or warranties about them or the products or services they offer. Any third-party websites you visit and use are up to you and at your own risk.

12. Indemnification

You will protect and defend Deals on Wheels and its affiliates and subsidiaries, as well as their respective shareholders, members, directors, managers, officers, employees, agents, and contractors, from and against any and all losses, damages, liabilities, and costs (including reasonable attorneys’ fees) (“Losses”) incurred by Deals on Wheels (or any of them) as a result of any third-party claim, suit, action, or proceeding related to your use of the Site. You also agree that Deals on Wheels will be in charge of defending or settling any claims from third parties, unless Deals on Wheels uses its right to ask you to defend Deals on Wheels or the other parties. This indemnity is in addition to any other indemnities that you and Deals on Wheels may have agreed to in writing.

13. General Disclaimers

Deals on Wheels Services and Content Are Provided “As Is,” “As Available,” and “With All Faults.” Deals on Wheels doesn’t make any promises, warranties, or endorsements, either directly or indirectly, about (A) Deals on Wheels Registry Services; (B) Content; (C) User Content; or (D) the security of Deals on Wheels’ transmission. disclaims all express and implied warranties, including, but not limited to, the warranties of merchantability, fitness for a particular purpose, that any results will be achieved, non-infringement, title, custom, trade, quiet enjoyment, system integration, and freedom from any dispute.

14. Class Action Waiver

Regardless of the forum, you and Deals on Wheels Registry agree that you may bring claims against each other only in your or its individual capacity, and not as a plaintiff or class member in any proposed class or representative proceeding.

15. Termination

No matter what these Terms say, we reserve the right, without notice and at our sole discretion, to end your right to access or use Deals on Wheels Services at any time and for any or no reason. You agree and acknowledge that if we do this, we will not be responsible or liable to you in any way.

16. The law that applies and where it applies

Deals on Wheels Registry operates Deals on Wheels Services from Canada and Dubai. The state’s laws, including its statutes of limitations, will apply to these Terms and the transactions they cover, including but not limited to their interpretation, construction, performance, and enforcement. This is true even if there are conflict or choice of law provisions. The International Convention on the Sale of Goods and other international agreements that are not required by contracts made and carried out entirely in Canada and Dubai will not apply.

17. Notice

All notices, demands, or permissions you give Deals on Wheels under these terms must be in writing and sent to the address below. Any notices to you may be sent via e-mail or postal mail to the address on file with Deals on Wheels, or by posting on Deals on Wheels Services. You agree that any notices, agreements, disclosures, or other communications sent to you electronically will meet any legal communication requirements, including, but not limited to, the requirement that such communications be in writing.

People with disabilities who need help reading these terms can contact us using the information in this section. We will consider reasonable requests to give these terms in a different format based on your needs.

18. Procedure for Filing Copyright Violation Claims

If you believe that any content on Deals on Wheels Services violates your copyright, please send the following information to our copyright agent in writing: (a) the electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; (b) a description of the copyrighted work that you say has been violated; (c) a description of where the allegedly infringing material is on Deals on Wheels Services; and (d) your address, phone number, and e-mail address.

19. Miscellaneous

We make no claim to ownership of user content. However, by uploading, posting, or submitting User Content to the Deals on Wheels Services or our pages or feeds on third-party social media platforms (for example, Deals on Wheels’ Facebook page, Instagram page, LinkedIn page, or Twitter feed), you hereby grant Deals on Wheels a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, and fully sublicensable right and license to use, reproduce, modify, adapt.
